Your membership of the Investigateway Members' Area is subject to the conditions hereunder and ticking the "I understand and accept" selector at the base of this page is your legal agreement that you understand and accept these conditions. You will not be able to proceed to the application form if you do not accept these conditions.
TERM - membership is not limited by a term unless you abuse privileges or share the password.
SINGLE USER - membership is issued to single users, meaning one person per single membership fee payment. Membership is not granted to non-persons such as agencies, offices, commercial premises where a single, or more, computer and internet connection is used by more than one person. Where it is expected that several users will have access to a single computer and therefore our members area under a single I.P. address, you are required to state this in your application form "Comments" area. We will then negotiate a unique membership fee for you.
WE MONITOR AND LOG ALL ACCESS INTO THE MEMBERS AREA and will cancel membership where logins have been shared.
FEE PAYMENT - a fee payment is required to obtain membership. If your payment is by way of cheque or other negotiable paper method then membership is issued upon clearance of the negotiable paper. If payment is by way of credit card or debit card processed through our payment processor then membership is issued within 24 hours of authorisation being issued by the payment processor. In extraordinary circumstances, such as network failure or catastrophic data destruction, you are entitled to a refund of your payment. Payment and credit card data is not held in our own computers but is processed by Paypal.
FEE CHANGES - we reserve the right to increase or reduce our fee for membership at any time without notice or explanation.
REFUSAL - we reserve the right to refuse membership to anyone without stating a reason. For example, we would refuse membership to persons with an I.P. range used in Nigeria. We will issue a full refund of fee payment where such was accepted and then refused.
REFUNDS - we we will refund your payment in full* for any reason, but only before membership has been used for the first time - meaning before you have logged into the members area for the first time. We first cancel your user ID and password and after we confirm your user ID and password have not been used to log in, we will issue a refund to the same account which was debited in the first place. Please note that our server tracks all logins and IP addresses. Refund is otherwise NOT AVAILABLE.
*a full refund is only given where the fee was paid by credit card. Where payment was made by cheque or money order (Australian applications only) we will give a refund minus costs we incur for banking and postage.
ABUSE - SHARING MEMBERSHIP - you are not permitted to share membership. If you share your membership we will immediately cancel your membership and you will not be entitled to a refund. All access to the members area is logged by server-side tracking and enables us to establish whether different computers shared a login.
Other forms of abuse will also result in cancellation of membership. Such abuse would be hacking attempts or abusive and threatening emails.
PRIVACY - our privacy policy is available for review. We believe in your right to privacy and we make every effort to protect it. We never share any information we derive from you or about you as result of your payment, your emails or access to the members area or any part of our website. We maintain members area access logs and we use special security software server-side which keeps record of I.P. address, user I.D., password, time and date logged in and logged out, the web pages viewed and files downloaded. None of this data is corelated to your name or email address, however, it can be corelated if necessary to check for abuse.
SECURITY- in addition to our privacy policy we undertake to comply with laws of Australia where it relates to financial transactions and personal information including credit card details. WE NEVER HAVE ACCESS to your financial or credit card data which is handled by Payapal.com, our payment processing company in the United States.
DOWNTIME - a webserver computers holding websites can break down. In such case you will not be able to access the members area. We do not guarantee the availability of our website or members area. In the case of server breakdown or other catastrophic events or the final closure of our website, we will not refund members fees.
CONTENT UPDATING and RELEVANCE - content available in the members area is updated from time to time, however, we do not guarantee the frequency or quantity or type of content updating. Our objective is to continually improve and grow the content in the members area.
All content, being ebooks, papers, guides, samples, shell documents and general advice is produced by an Australian investigator and consequently may be predominantly applicable to countries where the Westminster system of law applies, such as Australia, New Zealand and Canada. However, where techniques and special practices are concerned, the content in part or whole can apply to any country irrespective of law.
COPYRIGHT - all content whether visible or downloadable in the members area is subject to copyright as set out HERE and where copyright is held by other parties this is noted in the content. Breaches of copyright will be pursued fully. You may not copy or distribute any material downloaded from our website, however, you are permitted to use the "shell documents" - statements and reports - for the purpose for which these are clearly intended - to write reports and to record statements.
LOCATION OF MEMBERS AREA, WEBSITE & SERVER - the members area is contained within Investigateway.com.au website and the website is served at a network in the USA. This means all our content is published in the USA and your browser retrieves web pages and other files from the USA.
INDEMNITY & GUARANTEES - we do not assume liability or provide indemnity for any loss or damage that may arise from the use of information and advice, be that direct or implied, by any investigator or person or corporation. PLEASE READ INDEMNITY AND GUARANTEES.
